Below are our Terms and Conditions. This is all the legal stuff which protects us and you in a whole variety of situations. Please read them and get in touch if you’ve got any questions or queries.

Explanation of Website

eatstudent.com lets users search for their local takeaways, place their orders online and, if they choose, securely pay online. Any reference to “the Website” refers to www.eatstudent.com.

False and Malicious Orders

Any orders that are placed falsely or maliciously will be investigated by eatstudent. We can track the IP address of any user, if necessary, and will prosecute to the full extent of the law. Any user placing a false or malicious order can be fined up to £500 for damages.

Refunds & Returns Policy

Customers may on occasion wish to request a full refund. Refunds are always at the discretion of the restaurant. Any requests for refunds must be made within 72 hours of the order being placed. The customer must contact the restaurant directly in order to request a refund; a contact number is available on the e-mail confirmation that followed the order. If the restaurant agrees to the refund and the customer has paid by cash the refund must be coordinated directly with the restaurant. If the customer has paid online, and the restaurant agrees to the refund, please send an e-mail to info@eatstudent.com and we will refund the money. If a customer is ever unhappy with a restaurant's response, or with any aspect of the eatstudent experience, please contact us by email us and we will endeavour to resolve the issue.


Access to the Site

Any person accessing the Website shall be considered a user of the Website and therefore a customer of eatstudent. These Terms and Conditions govern the relationship between eatstudent and users of the Website.

Acceptance of the Terms and Conditions

By accessing or using any part of the Website, you indicate that you accept these Terms and Conditions in their entirety. If you do not accept these Terms and Conditions in their entirety, please leave the Website immediately.

You may also be bound by the Terms and Conditions of individual restaurants. These Terms and Conditions are unrelated and unaffected by our own and it is the responsibility of the user to ensure you comply with all such Terms and Conditions.

These Terms and Conditions must be read with and do not affect your statutory rights under the laws of England and Wales.

The Terms and Conditions may be revised at any time

eatstudent may revise these Terms and Conditions at any time by updating this document. You should check these Terms and Conditions regularly to review their current status, because they are binding on you – it is not our responsibility to actively inform you of changes to these Terms and Conditions. Some of these Terms and Conditions may be overridden by notices or terms on other pages of the Website.

Responsibility for accessing the Website

You are responsible for ensuring that all persons who access the Website through your Internet connection are aware of these Terms and Conditions and that they comply with them.

Intellectual Property

Users of the Website are allowed to download, copy or print any material on the Website for personal use only. Users are not allowed to download, copy, print, send or in any way use material on the Website for commercial purposes. Any use of any material on the website must receive the express written consent of eatstudent.

All copyright and intellectual property rights anywhere in the website, including but not limited to website design, graphics, text, logos, images, icons, all software and databases connected with the Website, are the property of eatstudent.

We cannot guarantee that the Website is always online

Although eatstudent will use its best endeavours to ensure the Website is normally available twenty-four hours a day, eatstudent will not be liable if the Website is unavailable at any time or for any period. Eatstudent shall not be liable for any damages or losses whatsoever caused by unavailability of the Website.

Eatstudent makes the Website available on “as-is’ and “as-available” basis. We make no representation or warranty of any kind, express or implied, in regards to the availability of the Website or its content. We do not guarantee that the Website will be error free or that errors will be rectified. We make no guarantees of any kind that the Website or server that makes it available are free of viruses or other such harmful components.

At certain times the Website may not be available to allow for routine maintenance and upgrades. Although eatstudent shall use its best endeavours to inform customers in advance of forecast unavailability, this cannot be guaranteed and eatstudent reserves the right to alter or withdraw the service at any time.

eatstudent is under no obligations to keep user information confidential unless it is covered in the Privacy Policy

Apart from personally identifiable information, any material transmitted or input on the Website will be considered non-confidential and non-proprietary. Eatstudent is under no obligations in respect to such material. Eatstudent and anyone we designate shall be free to copy, disclose, distribute, incorporate and otherwise use that material and all data, images, sounds, text and other things embodied in it for any and all commercial or non-commercial purposes.

We will uphold to protect all user information protected by our Privacy Policy

Eatstudent is committed to upholding your privacy. We operate a standard Privacy Policy, in keeping with all applicable UK and European rules and regulations. Unless eatsudent receives express permission, we shall not disclose or share any personal data with any third party, other than for the specific purpose of using the Website and placing orders, and compiling anonymous usage statistics. Purchasers shall at all times have a right to access, modify or delete their personal data which is held by eatstudent.

Misuse of the Website and suspending users

You may not misuse or abuse the Website in any way whatsoever. You may not use the site for any unlawful or unauthorised purpose. Damaging, disabling or impairing the operation of the Website or attempting to gain unauthorised access to the Website or to networks connected to it, through hacking, spoofing or other such similar means is completely prohibited.

Your access to the Website may be suspended temporarily or permanently and without notice. Your account may be suspended or deleted at the discretion of eatstudent. If we terminate your right to access the Website you must make no attempts to access the Website.

If any crimes are committed the relevant authorities will be immediately contacted, and eatstudent will cooperate in full.

Please note that we have the ability to trace your IP address, and if necessary, contact your ISP in the event of a suspected breach of these Terms and Conditions.

Users are prohibited from making false orders using the Website. We use cookies to monitor I.P. addresses as stated in our privacy policy in order to bar any computers we suspect are being used to place false orders. We reserve the right to seek compensation through legal action for any losses incurred as the result of such behaviour and will seek prosecution to the full extent of the law.

Due to the global nature of the Internet, users hereby agree to comply with all local rules and laws regarding on-line conduct and acceptable content.

Product Prices and VAT

All prices found on the Website are in British (Sterling) Pounds and inclusive of any VAT, and are to be considered final amounts for that product item, unless discounts or promotions result in lower prices, in which case such alterations will be clearly displayed.

By selecting cash as your payment method, you agree to provide the takeaway / restaurant payment in the form of UK Pound Sterling (£) upon receipt of your order.

Content on the Website may not be accurate, updated and may be changed at any time

Eatstudent will use its best endeavours to ensure that all information on the Website is accurate, complete and up to date at all times. We reserve the right to make changes to all content on the Website, including services and prices, at any time without notice. The material on the Website may be out of date, incomplete and inaccurate and eatstudent makes no guarantees to the contrary.

Links to third party websites

Links to third party websites on the Website are not the responsibility of eatstudent. We make no representations or warranties about their content or service. You access and use them entirely at your own discretion and risk.

You may provide links to the Website from any other website, but not in any way which implies, expressly or not, that eatstudent is associated with said website. Eatstudent reserves the right to insist upon the removal of any such links on other websites at any time whatsoever.

Warranties

Eatstudent will use it best endeavours to ensure that the Website is fit for purpose. However, to the maximum extent allowed by law, eatstudent makes no warranties whatsoever about the Website, its fitness for use, its content or the service provided. Your use of the Website is entirely at your own discretion and risk.

We do our utmost to ensure that the Website is safe and free from viruses, but we make absolutely no warranties that the Website will be free from viruses. Although we take all reasonable precautions to secure the Website, you acknowledge that the internet is not a completely secure medium and we make no warranties, express or implied, that any information or materials you post on or transmit through the Website will be safe from unauthorized access or use. If you are unsatisfied in any way with the functioning of the Website, or the service offered, your sole remedy is to discontinue using the Website.

Eatstudent and it’s directors are not liable for general losses that result from connection to this website.
Neither eatstudent nor its directors, officers, agents, employees or contractors shall have any liability whatsoever for any losses or damages of any kind arising from the use of the Website, or the inability to use the Website.

Eatstudent shall be indeminified against all loss, actions, proceedings, costs, expenses (including legal fees), claims and damages arising from your Access to and use of the Website, any breach or violation of the terms and conditions of the Website or your violation of any law or your violation of the rights of any third party.

Incorrect User Details

By placing an order the customer warrants that all personal information provided is correct and accurate. Incorrect telephone numbers, addresses or e-mail addresses may delay the order or result in its cancellation. Inputting false names is strictly prohibited. Eatstudent reserves the right to cancel an order if the information provided by the customer is incorrect or incomplete. Eatstudent reserves the right to cancel an order if there are problems with your online payment.

Delivery Timings

The waiting time for any order is a guideline only. Eatstudent provides a waiting time estimate merely as a convenience. Neither eatstudent nor its partner restaurants are under any legal obligation to comply with approximate waiting times, and are not liable should these waiting times not be met.

All food preparation and deliveries are the sole responsibility of the restaurant accepting the order. The restaurant will use its best endeavours to meet delivery times, however these may be affected by issues outside of their control.

Cancellation of an order

Once an order has been made it cannot be cancelled. If any changes need to be made to an order, please contact the retailer directly. Such changes are at the discretion of the restaurant. Contact details for the retailer can be found on the confirmation email. We reserve the right to cancel any order that is based on inaccurate information, or that we believe is suspect or fraudulent in any way.

How Credit Card Payments are handled

Eatstudent is authorised to take online payments on behalf of our partner restaurants. Eatstudent uses paypal to securely process customers’ online payments. Although eatstudent can take online payments, it does so merely as an intermediary, and by placing an order the customer enters into a contract not with eatstudent but with the restaurant. Any checks that paypal may or may not carry out against users cards are not at the behest or direction of eatstudent.

Credit Card Fraud

By selecting credit/debit card as a method of payment, you agree that you are fully authorized to use the credit/debit card in question.

We are just an intermediary between user and restaurant

Eatstudent will use its best endeavours to ensure that all orders placed on the Website are transmitted in a timely fashion to the relevant restaurant. However, eatstudent makes no warranties, expressly or otherwise, that this will happen without exception. Eatstudent can accept no responsibility or liability if an order is not transmitted to the relevant restaurant, due to factors beyond the reasonable control of eatstudent.

Eatstudent is an intermediary between the customers and our partner restaurants. As such the restaurant is responsible for all issues regarding the food, its preparation, its staff and its delivery. Eatstudent disclaims all liability in connection with such matters. Any queries about any food on the menus, any aspects of preparation or delivery should be directed to the restaurant in question. Any complaints about the food or service should be directed towards the restaurant. Although eatstudent will use its best endeavours to ensure that its partner restaurants offer the highest level of service, it cannot be held responsible should restaurants fail to meet those standards. Eatstudent has no control over the goods or services offered by its partner restaurants. All customers use the Website and order from our partner restaurants entirely at their own discretion and risk.

When you place an order you enter into a contract with the restaurant, not with eatstudent, which is merely an intermediary between you and the restaurant.

Once an order has been placed, the restaurant has sole responsibility for this order. Cash payments are to be made directly to the restaurant fulfilling the order.

E-receipts

After you submit your order on the Website you will receive an e-mail confirming the order. Please ensure that you provide a correct and functional e-mail address as all correspondence will be directed to this address.

Users with an account

Customers who hold an account are financially liable for all transactions made using their account. It is the responsibility of customers who hold an account to ensure that they keep the details of their account, such as their user name and password, strictly confidential, in order to ensure that their account is not used by any third parties without their knowledge. It is the responsibility of account holders to ensure that their accounts are not used to illegally purchase alcohol or cigarettes (see below).
Customers with accounts can edit their account information at their own discretion.

Alcohol and Cigarettes

In accordance with the Licensing Act 1964, it is an offence for any person under the age of 18 to buy, or attempt to buy, intoxicating liquor, or for any person over the age of 18 to buy intoxicating liquor on behalf of any person under the age of 18. Those under the age of 18 are strictly prohibited from ordering alcohol. It is the responsibility of the restaurants, not of eatstudent, to ensure that minors are not sold alcohol or cigarettes. Cigarettes or tobacco products are not available through eatstudent.com.

Miscellaneous

If any provision in these Terms and Conditions shall be deemed to be inappropriate, unlawful, or for any reason void, that provision shall be severable from the rest and shall not affect the validity of all other terms. If we delay or fail to exercise any of our rights pursuant to the violation of these terms and conditions, that shall not be constituted as a waiver of any of those rights.

Any provision in these Terms and Conditions which, explicitly or by implication, is intended to survive the termination of these Terms and Conditions, shall survive such termination.

No third parties shall acquire any rights under these Terms and Conditions as against eatstudent and/or any of its directors and/or employees and/or agents and/or licensors.

Any reference to “You” or “your” or “customer” or “user” refer to the customer on the Website, designated as any person who uses the Website in any way whatsoever. Any reference to “us” or “we” or “our” or “eatstudent” refers to eatstudent ltd, the company that operates and manages the Website. Any reference to “restaurant” or “partner restaurant” refers to the restaurants listed on the Website, and in particular context, the relevant restaurant.

These terms & conditions are governed by English law

These Terms and Conditions shall be governed by and construed in accordance with English law. Any disputes arising in connection with these terms & conditions shall be subject to the exclusive jurisdiction of the English courts.

The Website is intended to be accessed by persons located in the UK; we make no warranties that any information, materials or functions included in the Website are appropriate for use in any other jurisdiction.

These Terms and Conditions do not affect your statutory rights as a consumer.
